Please read these Terms of Service ("Terms") carefully before using the ofmar systems cms pro application (the "Service") operated by Ofmar Systems("us", "we", or "our").

1. Acceptance of TermsBy accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. User AccountsWhen you create an account with us, you must provide information that is accurate, complete, and current at all times.You are responsible for safeguarding the password that you use to access the Service.You agree not to disclose your password to any third party.You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Intellectual PropertyThe Service and its original content, features, and functionality are and will remain the exclusive property of Ofmar Systems and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Ofmar Systems.

4. Fees and PaymentCertain parts of the Service are billed on a subscription basis ("Subscription(s)").You will be billed in advance on a recurring and periodic basis (monthly or annually).At the end of each billing cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Ofmar Systems  cancels it.

5. Prohibited UsesYou agree not to use the Service:For any unlawful purpose or to solicit others to perform or participate in any unlawful acts.To upload or transmit viruses or any other type of malicious code.To infringe upon or violate our intellectual property rights or the intellectual property rights of others.To engage in "spamming" or any other activity that interferes with the performance of the Service.

6. TerminationWe may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

7. Limitation of LiabilityIn no event shall Ofmar Systems, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:Your access to or use of (or inability to access or use) the Service.Any conduct or content of any third party on the Service.Any content obtained from the Service.

8. DisclaimerYour use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

9. Governing LawThese Terms shall be governed and construed in accordance with the laws of the Republic of Panama, without regard to its conflict of law provisions. Any legal action or proceeding related to your access to, or use of, the Service shall be instituted in the courts of Panama City, Panama.

10. ChangesWe reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

Por favor, lea estos Términos de Servicio ("Términos") atentamente antes de utilizar la aplicación ofmar systems cms pro (el "Servicio") operada por ofmar system ("nosotros", "nos" o "nuestro").

1. Aceptación de los Términos

Al acceder o utilizar el Servicio, usted acepta estar sujeto a estos Términos. Si no está de acuerdo con alguna parte de los términos, no podrá acceder al Servicio.

2. Cuentas de Usuario

  • Cuando crea una cuenta con nosotros, debe proporcionar información que sea precisa, completa y actual en todo momento.

  • Usted es responsable de salvaguardar la contraseña que utiliza para acceder al Servicio.

  • Acepta no revelar su contraseña a terceros.

  • Debe notificarnos inmediatamente al tener conocimiento de cualquier violación de seguridad o uso no autorizado de su cuenta.

3. Propiedad Intelectual

El Servicio y su contenido original, características y funcionalidad son y seguirán siendo propiedad exclusiva de Ofmar Systems y sus licenciantes. Nuestras marcas comerciales e imagen comercial no podrán utilizarse en relación con ningún producto o servicio sin el consentimiento previo por escrito de Ofmar Systems.

4. Tarifas y Pago

  • Ciertas partes del Servicio se facturan mediante suscripción ("Suscripción(es)").

  • Se le facturará por adelantado de forma recurrente y periódica (mensual o anual).

  • Al final de cada ciclo de facturación, su Suscripción se renovará automáticamente bajo las mismas condiciones, a menos que usted la cancele o Ofmar Systems la cancele.

5. Usos Prohibidos

Usted acepta no utilizar el Servicio:

  • Para cualquier propósito ilegal o para solicitar a otros que realicen o participen en actos ilegales.

  • Para cargar o transmitir virus o cualquier otro tipo de código malicioso.

  • Para infringir o violar nuestros derechos de propiedad intelectual o los derechos de propiedad intelectual de terceros.

  • Para participar en "spamming" (correo no deseado) o cualquier otra actividad que interfiera con el funcionamiento del Servicio.

6. Terminación

Podemos dar por terminado o suspender el acceso a nuestro Servicio de inmediato, sin previo aviso ni responsabilidad, por cualquier motivo, incluyendo, entre otros, si usted incumple los Términos. Al finalizar, su derecho a utilizar el Servicio cesará inmediatamente.

7. Limitación de Responsabilidad

En ningún caso Ofmar Systems, ni sus directores, empleados o socios, serán responsables de daños indirectos, incidentales, especiales, consecuentes o punitivos, incluyendo, entre otros, la pérdida de beneficios, datos, uso, fondo de comercio u otras pérdidas intangibles, que resulten de:

  • Su acceso o uso (o incapacidad de acceso o uso) del Servicio.

  • Cualquier conducta o contenido de terceros en el Servicio.

  • Cualquier contenido obtenido del Servicio.

8. Exención de Responsabilidad

El uso del Servicio es bajo su propio riesgo. El Servicio se proporciona "TAL CUAL" y "SEGÚN DISPONIBILIDAD". El Servicio se proporciona sin garantías de ningún tipo, ya sean expresas o implícitas.

9. Ley Aplicable

Estos Términos se regirán e interpretarán de acuerdo con las leyes de la República de Panamá, sin tener en cuenta sus disposiciones sobre conflicto de leyes. Cualquier acción legal o procedimiento relacionado con su acceso o uso del Servicio se instituirá en los tribunales de la Ciudad de Panamá, Panamá.

10. Cambios

Nos reservamos el derecho, a nuestra entera discreción, de modificar o reemplazar estos Términos en cualquier momento. Si una revisión es material, intentaremos proporcionar un aviso de al menos 30 días antes de que los nuevos términos entren en vigor.
